THE POSITION:

DESCRIPTION OF WORK:

Represent the Commission in difficult and complex cases before appellate courts, both state and federal, by researching and evaluating the relative merits of legal positions, preparing briefs, memoranda, and relevant correspondence, and by making oral argument before the court.
 
Represent the Commission in litigation of major importance or complexity before trial courts, both state and federal, acting as trial counsel, by gathering facts, preparing witnesses, and preparing pleadings, briefs, and memoranda for the purpose of trial.
 
Represent the Commission in difficult and complex administrative proceedings before federal and other state agencies by researching and evaluating the relative merits of legal positions, preparation of discovery and witnesses and the drafting and filing of all necessary documents such as motions, briefs, comments, petitions, and other pleadings.
 
Advise Commissioners, executives and their assistants, and other Commission employees, on various matters through verbal and written communications including preparation of reports, recommendations and proposed Orders.
 
Prepare memoranda, reports, legal opinions, Secretarial letters, statutory interpretations, suggested orders and proposed regulations for Commissioners, the Chief Counsel, client bureaus, other agencies and the general public.
 
Provide, in response to inquiries, both internal to the Commission and external, informal legal advice and information, both written and verbal, on matters relating to the regulation of public utilities.
 
Represent the Commission at various meetings with utility executives; top governmental officials and the public.
 
Perform other related duties, as required.

Essential Function:

Ability to handle difficult, complex, and novel legal matters, including the conduct of high impact and complex litigation which has broad Commonwealth wide implications.
 
Ability to advise Commission executives on interpretation of laws and proper course of action.

Ability to represent the Commission in litigation of major importance or complexity before trial and appellate courts.
 
Ability to direct technical employees in the preparation, presentation, and defense of staff positions.
 
Ability to advise Commission officials with reference to revision and codification of existing statutes and the drafting of new legislation.
 
Ability to communicate with private citizens, utility executives, and top governmental officials to advise them on the Public Utility Law and Commission regulations.
 
Ability to analyze and organize facts, evidence, and precedents concerned in difficult and complex cases and in presenting such materials in clear and logical form.
 
Ability to analyze legal documents and instruments.
 
Ability to prepare legal documents and proposed legislation, regulations, and policy statements.
 
Ability to understand and interpret constitutional provisions, statutes, administrative regulations, and precedents.
 
Ability to maintain a professional rapport with state administrative officials, local governmental officials, employees, court officials, and with the general public.
 
Ability to travel to participate in trials, hearings, and appellate argument.
 

REQUIRED EXPERIENCE, TRAINING & ELIGIBILITY:

Three years of progressively responsible professional legal experi­ence, with some experience in highly responsible and complex professional legal work which provided exposure to governmental regulatory law (re­garding public utilities)/administrative law and graduation from an approved school of law

or

any equivalent combination of experience and training.

Necessary Special Requirement:

Possession of a certificate of admission to the Bar of the Supreme Court of Pennsylvania; or eligibility for such certification.
